1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Hemeify (ABN 13 868 958 380), a sole trader business based in Queensland, Australia ("we", "our", or "us").

By accessing or using the Hemeify service ("Service"), you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that:

  • You are at least 18 years old
  • You have the legal capacity to enter into these Terms
  • You will comply with these Terms and all applicable laws and regulations

All information provided by Hemeify, including reference ranges, insights, and trends, is for informational purposes only and is NOT a substitute for professional medical advice, diagnosis, or treatment.

You must:

  • Always consult your physician or qualified healthcare provider before making any health decisions
  • Never disregard professional medical advice or delay seeking it because of information from Hemeify
  • Consult your doctor before starting, stopping, or changing any medications or supplements

If you think you may have a medical emergency, call your doctor or emergency services immediately.

Supplement Insights

Supplement information shown in Hemeify is curated based on available research but should not be considered medical advice. Supplements may:

  • Interact with medications you are taking
  • Be contraindicated for your specific health conditions
  • Require monitoring by a healthcare professional

Reference Ranges

Reference ranges provided by Hemeify are for informational purposes only and may differ from those used by your healthcare provider or laboratory. Always defer to your doctor's interpretation of your blood test results and the reference ranges provided by your testing laboratory.

4. Description of Service

Hemeify provides a platform for you to:

  • Upload and store your blood test results
  • Upload documents (PDF, JPG, PNG) for automated extraction of lab results
  • Track biomarker trends over time
  • View reference ranges for various health markers
  • Receive educational information about health markers and supplements

Important: Hemeify does not integrate directly with pathology laboratories or healthcare providers. All data is uploaded by you. When using document extraction, you should review extracted values for accuracy before saving.

5. Subscriptions and Billing

Subscription Plans

Access to the Service requires a paid subscription. We offer monthly and yearly billing options. Current pricing is displayed on the subscription page. Prices are shown in USD and may vary by region due to applicable taxes.

Free Trial

New users receive a free trial period. During the trial you have full access to the Service. If you do not subscribe before the trial ends, your access will be suspended until you subscribe. We may delete your data if your account remains inactive for an extended period.

Billing and Auto-Renewal

  • Subscriptions automatically renew at the end of each billing period (monthly or yearly) unless cancelled
  • You will be charged at the beginning of each renewal period at the rate you subscribed at
  • Payment is processed by our third-party payment processor. We do not store your payment card details

Cancellation

  • You may cancel your subscription at any time from your account settings
  • Cancellation takes effect at the end of your current billing period — you retain access until then
  • We do not provide refunds for partial billing periods, except as required by applicable law
  • After cancellation, you may request a data export or delete your account as described in our Privacy Policy

Price Changes

We may change subscription prices from time to time. We will provide at least 30 days' notice before any price increase takes effect. If you do not agree to the new price, you may cancel before it applies.

6. User Account and Responsibilities

You are responsible for:

  • Maintaining the confidentiality and security of your account credentials
  • All activities that occur under your account
  • Ensuring the accuracy of the health data you upload (we do not verify or validate your data)
  • Notifying us immediately of any unauthorized access or security breach
  • Complying with all applicable laws and regulations

You agree NOT to:

  • Share your account credentials with others or allow others to use your account
  • Use the Service for any unlawful, fraudulent, or malicious purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated tools (bots, scrapers) to access or extract data from the Service
  • Upload false, misleading, or harmful information
  • Interfere with or disrupt the Service or its infrastructure

7. Your Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

  • You grant us permission to use your data to provide the Service
  • We may anonymize and aggregate your data for research purposes (see Privacy Policy)
  • You can request a data export or delete your account at any time
  • We do not sell your personal or health information

8. Communications

Service Communications

By creating an account, you agree to receive service-related emails from us, including account notifications, security alerts, payment reminders, and product updates relating to the Service you are subscribed to. These communications are a necessary part of the Service and cannot be opted out of while your account is active, though you may unsubscribe from specific categories of non-critical service emails.

Marketing Communications

With your explicit consent, we may send you marketing emails such as blog posts, educational content, and promotional offers. You can opt in during onboarding and opt out at any time via the unsubscribe link in any marketing email. Opting out of marketing communications does not affect service communications.

9. Intellectual Property

Hemeify and its licensors own all rights, title, and interest in the Service, including its original software, design, user interface, branding, and compilation of content. The Service is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes, subject to these Terms.

You may not:

  • Copy, modify, or create derivative works of the Service or its original software
  • Scrape, extract, or reproduce the Service's data, content, or functionality for commercial purposes
  • Remove or modify any copyright, trademark, or other proprietary notices

Your Content: You retain ownership of the health data you upload. By using the Service, you grant us a license to use, store, and process your data as described in our Privacy Policy.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

We disclaim all warranties to the maximum extent permitted by law, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Any warranty that the Service will be uninterrupted or error-free
  • Any warranty regarding the accuracy, completeness, or reliability of information provided
  • Any warranty that defects will be corrected or that the Service is free of viruses or harmful components

You acknowledge that:

  • We do not verify, validate, or confirm the accuracy of your uploaded data
  • Reference ranges are educational and may not reflect medical consensus
  • The Service may contain errors, bugs, or inaccuracies
  • You use the Service at your own risk

11. Limitation of Liability

To the maximum extent permitted by law, Hemeify and its operators shall not be liable for any damages arising from your use of the Service.

This includes, but is not limited to:

  • Health-related damages: Any health complications, injuries, or adverse effects resulting from decisions made based on information from the Service
  • Data loss: Loss or corruption of your health data (except where caused by our gross negligence or intentional misconduct)
  • Service disruption: Interruptions, downtime, or unavailability of the Service
  • Financial damages: Any costs incurred from medical treatments, tests, or consultations
  • Indirect damages: Any indirect, incidental, special, consequential, or punitive damages

Maximum Liability: In any event, and to the extent liability cannot be excluded under applicable law, our total liability to you shall not exceed the total subscription fees you have paid to us in the 12 months immediately preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Hemeify, its operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any laws or regulations
  • Your violation of any third-party rights, including intellectual property rights
  • Any health decisions or actions you take based on information from the Service

13. Termination

Your Rights: You may cancel your subscription and delete your account at any time through the Service settings. Upon deletion:

  • Your personal data will be deleted within 30 days (with backups purged within 90 days, as described in our Privacy Policy)
  • You will lose access to the Service immediately
  • Anonymized data may be retained as described in our Privacy Policy

Our Rights: We may suspend or terminate your access to the Service, without notice, if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • Your account poses a security risk
  • We discontinue the Service (we will provide reasonable notice where possible)

14. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by:

  • Posting the new terms on this page
  • We will update the "Last updated" date
  • We will present the updated Terms for your review and acceptance at your next login

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of Queensland, Australia, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service will be subject to the jurisdiction of the courts of Queensland, Australia, except where mandatory consumer protection laws in your jurisdiction require disputes to be resolved in your local courts.

Dispute Resolution Process:

  1. First, contact us at legal@hemeify.com to attempt informal resolution
  2. If unresolved within 30 days, either party may pursue formal legal action

16. Miscellaneous

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hemeify regarding the Service and supersede all prior agreements.

Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

Consumer Rights

Nothing in these Terms affects your statutory rights under applicable consumer protection laws, including the Australian Consumer Law. Where local consumer protection laws apply, the provisions of these Terms are subject to those laws.
